Biography

Carlyn Irwin is an expert with more than twenty-five years of litigation consulting experience in matters related to general damages, accounting and intellectual property. Ms Irwin specialises in financial, economic and accounting issues, with an emphasis on damages claims, financial forensic analysis, and investigations. She has specific expertise in estimating lost profits, unjust enrichment and reasonable royalty damages, including analysing causation and apportionment issues. Ms Irwin has testified on a range of complex commercial disputes, including matters related to financial forensics, corporate reporting and intellectual property.

Ms Irwin has extensive experience with reconstructing financial records, tracing transactions through corporate reporting systems, and reviewing financial records to assess consistency and reliability. Her financial forensic analysis has included civil and criminal litigation involving white collar matters, allegations of fraudulent conveyances, breach of contract and alleged fraud. Her forensic accounting testimony has included cases alleging fraud, fraudulent transfer and alter ego, and breach of contract.

Ms Irwin has estimated damages in patent, trademark and copyright infringement, as well as trade secret misappropriation disputes. Her expertise covers numerous industries, including computer and internet-based technology, consumer products, defence contracting, entertainment, medical devices and professional services.

Her recent case experience includes Morgan et al v US Soccer Federation Inc, a matter involving equal pay claims.

In breach of contract and tort causes of action, Ms Irwin has analysed causation and damages issues including breach of fiduciary duty, false advertising, Lanham Act and unfair business competition. Her industry experience in these matters includes communications and broadcasting, consumer products, financial and professional services, internet-related businesses, real estate development, and technology.
